Case Title

ATARIKA KUSSASI and Others v THE REPUBLIC 1970 GLR 20

Case Principle
locus in quo; view of crime scene by magistrate alone
Case Authority
Although the private visit by the magistrate to the locus in quo was not irregular, it was simply made in order the better to understand the evidence already given. The visit, furthermore, did not occasion a substantial miscarriage of justice. Salsbury v Woodland [1969] 3 W.L.R. 29 CA. and Oyefolu v The King (1951) 13 WACA. 186 applied.
