Under rule 5(10) of the Legal Profession (Professional Conduct and Etiquette) Rules, 1969 (L.I. 613), a lawyer was under a duty to avoid representing conflicting interests. Furthermore, failure by a lawyer to exhibit utmost honesty and frankness to his client constituted professional misconduct under rule 9(7) of L.I. 613. On the evidence, the appellant failed to maintain the highest standard of professional conduct in his dealings with the complainant. His denial of the complainant was unworthy of any one who pursued the honourable calling of a lawyer. Accordingly, he was properly convicted by the disciplinary committee.
